Conditions of participation in the "Bohemian Border Bash Race Raffle"
Please read the terms and conditions carefully before you decide to participate in the Bohemian Border Bash Race Raffle. By participating in this competition, you automatically accept the following conditions of participation in full and without exception.
The legal organizer of the competition is ORTLIEB Sportartikel GmbH. Questions, comments and complaints, as well as any claims and/or demands in connection with the competition must be addressed directly to ORTLIEB. ORTLIEB shall not be liable for performance disruptions, personal injury or property damage in connection with the competition. ORTLIEB has commissioned the Upljft GmbH, Vorsetzen 32, 20459 Hamburg, Germany (hereinafter "Agency") to plan the competition.
In paragraph 9. we declare ourselves to the use of your personal data in the context of the competition and the prize processing.
By entering the competition, all participants without exception accept the conditions of participation and the applicability of German law.
Participation in the competition requires that the participating person has an Instagram account. Each person may only enter the competition with one Instagram account and is only entitled to win once.
Eligible to participate are all persons of unlimited legal capacity, who at the time of participation have reached the age of 18. No prizes will be distributed to minors who nevertheless participate.
It is not dependent on the purchase of goods or services or the ordering of a newsletter.

Decisive for the timeliness of the participation is the electronically recorded receipt of the entry post to the competition post. ORTLIEB is not liable for the late or incomplete receipt of the entry post and cannot be held responsible in particular for technical faults, e.g. for failures of the telephone network, the network, the electronics or the computer.
Please note:
you should already have some experience of such races and be physically and mentally fit and healthy.
All participants who meet the above conditions are considered in the selection process. Among all participants who effectively participate in the competition according to these terms of participation, a winner is selected by a jury at its own and free discretion. The jury consists of two responsibles of the company ORTLIEB.
The raffle starts on February 2nd, 2022 and ends on February 2nd, 2022. The winner will be notified within three business days after selection via direct message and will be asked to return the full name and postal address (street, house number, postal code, city).
If the winner does not respond within one week of the private message being sent, the claim to the prize will be forfeited. In this case a new participant will be determined and notified. ORTLIEB reserves the right to exchange the prize (or parts of the prize) for a prize or prizes of equal or higher value if this should be necessary for reasons of force majeure.
Employees of ORTLIEB, upljft and associated companies, as well as their family members and relatives are excluded from participation. Persons who submit false personal data are excluded from participation.
The organizer does not guarantee the prizes, unless there is a case of fraudulent misrepresentation.
ORTLIEB is not liable for damages due to technical malfunctions, for delays or interruptions in transmissions or for losses, costs or damages related to participation in the competition, unless ORTLIEB acts with intent or gross negligence.
This shall not affect any claims for compensation based on product liability and injury to life, body and health as well as essential contractual obligations, i.e. such obligations whose fulfilment is essential for the proper execution of the contract and on whose compliance the contractual partner regularly relies and may rely.
If there is reason to believe that a participant or a third party is attempting to manipulate the course of participation through fraud, deception, or deceptive or unsportsmanlike actions, ORTLIEB reserves the right to disqualify that person from participation at its sole discretion.
ORTLIEB reserves the right to change these terms and conditions of participation if the change is necessary and reasonable for the participant, taking into account ORTLIEB's interests. If the participant does not object to the change within the time limit set by ORTLIEB, the change will be considered approved. ORTLIEB informs the participant of this fact in the change notification.
ORTLIEB reserves the right to cancel the competition for important reasons. A termination for good cause can occur in particular if a proper execution of the lottery can no longer be guaranteed for technical or legal reasons. In the event of an abort, there are no claims against ORTLIEB or Uplijft. The judges' decision is final.
Complaints about the course of participation must be submitted in writing to ORTLIEB within 14 days of the problem occurring. The decision on the selection of the winners and the result is final. The execution of the participation is subject to German law. Should any of the above terms and conditions be or become invalid, this shall not affect the validity of the remaining provisions.
The contest is not affiliated with Instagram and is in no way sponsored, endorsed or organized by Instagram. Instagram is not responsible for any content published in this promotion.
The recipient of the information provided by the participant is not Instagram but ORTLIEB. ORTLIEB indemnifies Instagram from any claims by third parties in connection with this contest.
Responsible body for the processing of your personal data within the framework
of this competition is ORTLIEB Sportartikel GmbH, Rainstraße 6, 91560 Heilsbronn, Germany (hereafter referred to as "responsible party").
With regard to the scope and purpose of data processing, a distinction must be made between simple participation in the competition on the one hand and the processing of the prize with the winner on the other.
When you participate in the competition, we process the following data from you:
Public Instagram profile information including username We process the personal data of the participants to carry out the competition, in particular to determine whether you are entitled to participate and to determine and notify the winner. If you do not provide us with the above-mentioned data, participation in the competition or contact with regard to notification of a win is not possible.

The agency treats your data as confidential as we do. For this purpose, we have concluded a contract for order processing with the agency.
ORTLIEB will store your data for the duration of the competition. As far as there are no legal storage obligations, the data will be deleted immediately after the competition has been completed.
The information you post in this contest will remain stored with Instagram and available on the ORTLIEB Instagram page as long as this page is not deactivated, the contest post is not deleted and you do not delete the route or your account with Instagram.
